La Asamblea Legislativa aprob\u00f3 la semana pasada la LEY DE ATRACCI\u00d3N DE INVERSIONISTAS, RENTA FIJA Y PENSIONISTAS, como parte de las medidas propuestas por el Gobierno de Costa Rica para la reactivaci\u00f3n econ\u00f3mica en el per\u00edodo post pand\u00e9mico.<\/span><\/p>\n

Esta ley estableci\u00f3 un conjunto de beneficios y\/o exoneraciones tributarias que el pa\u00eds otorgar\u00e1 a los extranjeros que deseen solicitar una Residencia en Costa Rica, bajo tres categor\u00edas espec\u00edficas, durante la vigencia de la ley.<\/span><\/p>\n

El art\u00edculo No. 11 de la citada Ley estableci\u00f3 que el Poder Ejecutivo cuenta con 60 d\u00edas para emitir el Reglamento correspondiente, el cual brindar\u00e1 mayor claridad sobre los detalles de implementaci\u00f3n de esta ley.<\/span><\/p>\n

La ley establece las siguientes prestaciones:<\/span><\/p>\n

    \n
  1. Exenci\u00f3n \u00fanica del impuesto de importaci\u00f3n para art\u00edculos del hogar. Que incluye, entre otros, muebles y art\u00edculos de decoraci\u00f3n del hogar, electrodom\u00e9sticos, utensilios de cocina y ba\u00f1o y ropa de cama.<\/span><\/li>\n
  2. Exenci\u00f3n de impuestos de importaci\u00f3n, arancelarios y sobre el valor a\u00f1adido de hasta dos veh\u00edculos de transporte terrestre, a\u00e9reo y\/o mar\u00edtimo para uso personal o familiar.<\/span><\/li>\n
  3. Las cantidades declaradas como renta para hacerse acreedor de los beneficios de esta ley estar\u00e1n exentas del IRPF.<\/span><\/li>\n
  4. Exoneraci\u00f3n del 20% de la cuota \u00edntegra del Impuesto sobre Transmisiones Patrimoniales de los bienes inmuebles que adquieran durante la vigencia de la ley y que est\u00e9n inscritos a nombre del residente beneficiario.<\/span><\/li>\n
  5. Exenci\u00f3n de impuestos a la importaci\u00f3n de instrumentos o materiales para la pr\u00e1ctica profesional o cient\u00edfica que se demuestre al Ministerio de Hacienda que son esenciales para su actividad econ\u00f3mica.<\/span><\/li>\n<\/ol>\n

    Adem\u00e1s, la citada ley redujo el importe m\u00ednimo de inversi\u00f3n que se requiere para solicitar la residencia en la categor\u00eda de Inversor a $ 150.000,00 USD, y aprob\u00f3 la inclusi\u00f3n en esta categor\u00eda de inversores que participen en fondos de capital riesgo y\/o en proyectos de infraestructuras tur\u00edsticas sostenibles.<\/span><\/p>\n

    Para la tramitaci\u00f3n de los visados de residencia contemplados en esta ley, la Direcci\u00f3n General de Migraci\u00f3n y Extranjer\u00eda ser\u00e1 la Instituci\u00f3n encargada, por lo que tiene la obligaci\u00f3n de habilitar una oficina exclusiva para la atenci\u00f3n de los beneficiarios, especialmente enfocada a los criterios de simplificaci\u00f3n de tr\u00e1mites. Y en cuanto a las exenciones fiscales y otros aspectos tributarios, estar\u00e1n a cargo del Ministerio de Hacienda.<\/span><\/p>\n

    Los extranjeros que soliciten los beneficios concedidos en esta ley en los primeros cinco a\u00f1os, los conservar\u00e1n durante un periodo de 10 a\u00f1os a partir de la fecha en que les fueron concedidos.<\/span><\/p>\n
